DUI Penalties

Penalties are extremely severe for DUI convictions.  Even on a first conviction you can be fined up to $1,000 and sentenced to 6 months in jail and have your license suspended for 90 days.  If you caused bodily injury to someone else, if a passenger was under age 16, or if you were over 21 and driving with a passenger under 18 the maximum penalty is $2,500 and one year in prison.  The third conviction is a 3rd degree felony if it occurred within 10 years of the first two convictions.  Your license will be suspended for at least a year.  The maximum penalty is $5,000 and five years in prison.  Further penalties are imposed if you refused to submit to chemical testing or had an open container.
